How Maine treats lien waivers
Maine does not prescribe a lien waiver form: its mechanics lien statute (10 M.R.S. §§ 3251–3269) is silent on waivers, requires no notarization, and contains no anti-waiver provision, so our general-purpose conditional and unconditional progress and final waivers apply. Because waivers are governed by ordinary contract principles, enforceability turns on clear language, a signature, and a well-defined scope. Stating the exact amount, through date, and property on each waiver protects both sides, since nothing in statute limits overbroad waiver language.
