Alabama Lien Waivers: No Statutory Form, the Waiver's Terms Control

State Rules

How Alabama treats lien waivers

Alabama does not prescribe a lien waiver form: the mechanics' lien act (Ala. Code § 35-11-210 et seq.) says nothing about waiver form or content, so our general-purpose conditional and unconditional progress and final waiver forms apply, with no notarization required. Because Alabama has no anti-waiver statute, lien rights can even be waived in advance of payment when the intent to waive is clear and explicit, making conditional waivers tied to actual payment the prudent choice for claimants. Ambiguities in a waiver are construed against the drafter and in favor of preserving lien rights.

Alabama lien waiver forms we generate

Four house forms cover every payment on a Alabama project: conditional or unconditional, progress or final.

Conditional Progress

Conditional Waiver and Release of Lien: Progress Payment

Signed when a progress payment is promised: the waiver only takes effect once that payment actually arrives.

Unconditional Progress

Unconditional Waiver and Release of Lien: Progress Payment

Signed after a progress payment has been received: immediately waives lien rights for work through the covered date.

Conditional Final

Conditional Waiver and Release of Lien: Final Payment

Signed when the final payment is promised: waives all remaining lien rights, but only once the payment clears.

Unconditional Final

Unconditional Waiver and Release of Lien: Final Payment

Signed after the final payment is in hand: a complete, immediate waiver of lien rights on the project.

Signing a lien waiver in Alabama

Execution rules (the form's wording, notarization, witnesses, and whether an electronic signature works) are set by state law. Here's what applies in Alabama, built into every waiver we generate.

Advance waivers

Alabama has no anti-waiver statute: the mechanics' lien act (Ala. Code § 35-11-210 et seq.) does not regulate waiver form or content, and under Alabama case law lien rights may be waived in advance of payment, including through a "no-lien" contract clause, so long as the intent to waive is clear and explicit. Ambiguous waivers are construed against the drafter and in favor of preserving lien rights.
