Delaware does not require a notice of intent before recording a lien, but sending one is often what gets the invoice paid.
Recording and enforcing a Delaware lien
Recording the lien
Record with the circuit court clerk for the county. Electronic recording is not generally available, so build mailing time into the deadline. The lien must be notarized. The lien claim must be sworn to under oath.
After recording
Delaware does not require a separate notice after the lien is recorded, though most claimants send one anyway to prompt payment.
Wrongful lien exposure
Delaware has no dedicated wrongful-lien penalty statute, but an inflated or baseless lien can still be challenged and removed at the claimant's expense.
Practitioner notes for Delaware
Direct contractor filing deadline: statement of claim within 180 days after completion of structure; statute also deems timely if filed within 180 days of several alternative events (e.g., final invoice, certificate of occupancy, 90% payment) (25 Del. C. §2711(a)). All other claimants: statement of claim within 120 days from completion of labor/last delivery of materials; also deemed timely within 120 days of (i) when final payment (incl. retainage) is due to claimant or (ii) when final payment is made to the direct contractor (25 Del. C. §2711(b)). Statement of claim/complaint is filed with the Prothonotary of the Superior Court (25 Del. C. §2712(a)) and must be supported by claimant affidavit (25 Del. C. §2712(c)). Proceeding to recover is by writ of scire facias (25 Del. C. §2714).
